    (CBS News) — In the escalating battle between the administration and the judiciary, a federal appeals court apparently is calling the president’s bluff — ordering the Justice Department to answer by Thursday whether the Obama Administration believes that the courts have the right to strike down a federal law, according to a lawyer who was in the courtroom.

    The order, by a three-judge panel of the U.S. Court of Appeals for the 5th Circuit, appears to be in direct response to the president’s comments yesterday about the Supreme Court’s review of the health care law. Mr. Obama all but threw down the gauntlet with the justices, saying he was “confident” the Court would not “take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.”

    Overturning a law of course would not be unprecedented — since the Supreme Court since 1803 has asserted the power to strike down laws it interprets as unconstitutional. The three-judge appellate court appears to be asking the administration to admit that basic premise — despite the president’s remarks that implied the contrary. The panel ordered the Justice Department to submit a three-page, single-spaced letter by noon Thursday addressing whether the Executive Branch believes courts have such power, the lawyer said.

    The panel is hearing a separate challenge to the health care law by physician-owned hospitals. The issue arose when a lawyer for the Justice Department began arguing before the judges. Appeals Court Judge Jerry Smith immediately interrupted, asking if DOJ agreed that the judiciary could strike down an unconstitutional law.

    The DOJ lawyer, Dana Lydia Kaersvang, answered yes — and mentioned Marbury v. Madison, the landmark case that firmly established the principle of judicial review more than 200 years ago, according to the lawyer in the courtroom.

    Smith then became “very stern,” the source said, telling the lawyers arguing the case it was not clear to “many of us” whether the president believes such a right exists. The other two judges on the panel, Emilio Garza and Leslie Southwick — both Republican appointees — remained silent, the source said.

    Smith, a Reagan appointee, went on to say that comments from the president and others in the Executive Branch indicate they believe judges don’t have the power to review laws and strike those that are unconstitutional, specifically referencing Mr. Obama’s comments yesterday about judges being an “unelected group of people.”

    I've been saying for three + years that this guy is nothing more than the point man for some bigger group aimed at a socialist re-invention of our nation.

    He enters into armed conflicts without so much as mentioning it to Congress. He appoints 34 czars with no congressional oversight. He rammed a healthcare bill through that 68% of Americans were against. Now he threatens the Supreme Court.

    The coming decision on the individual mandate could be the watershed moment in whether we remain a democracy or follow Europe down the path of socialism to our own destruction.

    (The Hill) — President Obama kicked off the sunny Easter weekend on Saturday with a trip to the golf course.

    The president, a frequent golfer, left the White House shortly before 1 p.m. for a ride to what has become his home course at Andrews Air Force Base.

    The weather is beautiful in the Washington D.C. area this weekend, sunny with temperatures in the low 60s.

    It’s the second round of golf for Obama this Spring, and also the second time this week the White House has put golf on the agenda.

    He knew what he was doing. The trillion dollars of our money went to buy votes for him and his Chicago cronies. Watch the Congressional investigations. Solyndra execs are pleading the 5th to avoid prison...GSA administrators are now pleading the 5th after they got caught on camera laughing at the American taxpayers that they were ripping off...Now the Secret Service and military scandals...

    Obama has turned the entire federal government into a cesspool of corruption. The "Sleeze Factor" has become a campaign issue. This election is between a Chicago con-artist and a guy who really does give 10% to his church...

    CBO: Obama’s 2013 Budget Will Hurt the Economy — Obama: Not Fast Enough

    (The Hill) — The nonpartisan Congressional Budget Office said Friday that President Obama’s 2013 budget will hurt the economy in the long term, arguing the larger deficits it would produce would reduce the amount of capital available to businesses.

    After five years, the CBO says, the Obama proposals would reduce economic output by between 0.5 percent and 2.2 percent.

    Larger deficits caused by the budget would cause the government to issue more bonds, sucking up private capital to finance its debts and thereby reducing the funds businesses could use to expand and hire, the CBO said. An increased tax on capital gains included in the president’s plan would also tend to reduce private capital, it says.

    The 2013 Obama budget proposes continuing the Bush tax rates for the middle class and enacting elements of a short-term Jobs Act stimulus. In the near term, actions such as these could increase growth by as much as 1.4 percent, CBO says.

    The new CBO report complements a March estimate that Obama’s budget would add $3.5 trillion to deficits over 10 years compared to current law. That report did not try to capture any effects on economic growth.

    In 2007, then-Illinois Sen. Barack Obama missed two votes on the student loan interest bill that he now wants Congress to extend.

    Obama twice skipped the Senate vote on the College Cost Reduction and Access Act when the bill came to the Senate floor first in July and again in September of 2007, according to public records.

    The bill, introduced by Rep. George Miller (D-Calif.) and signed into law by President George W. Bush, first cleared the Senate in July on a 78 to 18 vote, with Obama as one of only four senators to abstain. Obama did not cast a vote again in September, after the House and Senate had ironed out different versions of the bill. He was on the conference committee assigned to merge the House and Senate versions of the bill.

    He issued a statement when the bill was signed by President Bush, saying, “by investing in education we are restoring America’s competitiveness in the world, and today is an important step forward.”

    Obama has made keeping student loan interest rates low a new priority for his administration — but as a senator, he neither voted for Miller’s bill nor signed on as a cosponsor.

    (CNSNews.com) — The Green River Formation, a largely vacant area of mostly federal land that covers the territory where Colorado, Utah and Wyoming come together, contains about as much recoverable oil as all the rest the world’s proven reserves combined, an auditor from the Government Accountability Office told Congress on Thursday.

    The GAO testimony stressed that the federal government was in “a unique position to influence the development of oil shale” because the Green River deposits were mostly beneath federal land.

    It also noted that developing the oil would pose “socioeconomic challenges,” which included bringing “a sizable influx of workers who along with their families put additional stress on local infrastructure” and “making planning for growth difficult for local governments.”

    “The Green River Formation — an assemblage of over 1,000 feet of sedimentary rocks that lie beneath parts of Colorado, Utah, and Wyoming — contains the world’s largest deposits of oil shale,”Anu K. Mittal, the GAO’s director of natural resources and environment said in written testimony submitted to the House Science Subcommittee on Energy and Environment.

    “USGS estimates that the Green River Formation contains about 3 trillion barrels of oil, and about half of this may be recoverable, depending on available technology and economic conditions,” Mittal testified.

    The biggest worry that Dems have is that they're army of victims won't turn out in big numbers in the next election. So, they need to manufacture stories to get out the vote. First we had the made up REPUBLICAN WAR ON WOMEN. And we have the ROMNEY ATTACK ON THE YOUNG HOMOSEXUAL. The only thing that is missing is a story to motivate the black vote. Oh, wait, Sharpton and Jackson are stoking the TRAYVON MARTIN story.
    Forget the economy, health care, a nuclear Iran, we've got real campaign issues here. :roll:

    This story was a very telling mis-step by Obama and the Dem machine. It was so sophomoric that it reeked of desperation even if true. Pounding the gay marriage angle again is another.

    The old hot button issues pale in the wake of destruction that Obama has wrought in three + years.

    According to Edward Klein in today’s New York Post, then-Senator Barack Obama’s political campaign tried, through back channels, to bribe Rev. Jeremiah Wright not to speak during the 2008 election cycle. The price: $150,000.

    According to Wright, “one of Barack’s closest friends” directed an offer to Wright through a member of Wright’s church. Obama also asked to meet with Wright “in secret, in a secure place.” They met one-on-one. Here’s what happened at the meeting, according to Wright:

    “Barack said, ‘I’m sorry you don’t see it the way I do. Do you know what your problem is?’ And I said, ‘No, what’s my problem?’ And he said, ‘You have to tell the truth.’ I said, ‘That’s a good problem to have. That’s a good problem for all preachers to have. That’s why I could never be a politician.’

    Some of you know that I have insight into the gay community. I do not claim to know everything nor do I claim to speak for them. Just that I have access to individuals in that community to hear their opinions.

    Obama rolled snake eyes on this attempt to buy votes. The straight community moves away from him for his support of gay marriage. The gay/lesbian community is angry for it taking three years and see this for what it is... lip service to get votes.
