Not surprising, she's been in ill health for quite awhile now. Probably would have resigned had a democrat been in office. I didn't agree with her politics, but she was a very intelligent justice and a credit to the court. The issue of replacing her or attempting to replace her before the Nov 3 election is going to be a nasty fight. I don't really know how I feel, on the one hand I would like to see the court get another conservative but on the other hand I hate it that we are going to go through what lies ahead. I wonder when Trump will offer up his nomination. I will be shocked if it's not a woman.

Trump should absolutely nominate a Supreme Court Justice. That is his job and duty. Just as it was Obama's job and duty to nominate Merrick Garland. I am sure he will be bitterly attacked for doing so, anyway. The question in my mind is, should the Senate confirm, or defer until after the election? I have no answer. However, I am sure almost every Senator that was in office in 2016 will be making the opposite argument they made as regards Garland. Because, politics.
I agree, Kes...I'm in a bit of feeling hypocritical about wanting them to go ahead and confirm a justice. Both sides will indeed be flip flopping their statements from before. The thing that sways me, in the end, I think, is that the majority party in the Senate has the power to do it (assuming the GOP senators all stick together...not a given for sure). The majority party in the House has not been shy about wielding it's absolute power. They've stymied the Senate at every turn, from looking at police reform to compromising on a second stimulus package. And when the Dems had the Senate they didn't hesitate to use that power to do away with the filibuster (how's that looking now, Harry?) So forget about what everybody said before etc...use the power while you have it. In fact, I don't recall exactly the quotes so I could be wrong...but I think McConnell's attitude last time was no so much "waiting for the election is the right thing to do" but rather was "we're just flat out not going to have a vote because I don't have to do it."
Once again Murkowski balks and Collins looks like this time she's with her. If they think tearing fetuses' out of the womb is no big deal fine, but don't take Republican donations to run. I doubt Murkowski will run for reelection but I'm going to contribute to a primary opponent if there is one.
Murkowski lost her Republican primary last time. Then she ran as an independent in the general election and won a 3-way race with both Democrats and Republicans. Alaska is a strange place.
TOK, The other arrows in Pelosi’s quiver: Assuming Biden wins and Dems capture the Senate and hold onto Congress, the Congress and Senate would be able by law to add new members to the Supreme Court; in addition, they have the power to make DC and Puerto Rico states which would add 4 Democratic senators to the Senate given the demographics of each region. Although there would be severe backlash to either move, the degree of political animosity is so high that there would be strong Democratic support for both options regardless of the consequences. The vote occurs when the Speaker schedules it. The current practice is to first have hearings in the Senate Judicial Committee but that's not a prerequisite. After the way those crude opponents of Cavanaugh acted, they should just skip them this time.
