Could be tough making the DUI stick. The police officer can't testify to his driving the car. SUI (sleeping under the influence of alcohol) isn't a crime.
In Fla as well, just ask the esteemed manager of the St. Louis Cardinals what happens when you fall asleep at a stop light drunk, for that matter ask Willie Nelson what happens when you've drunk too much, smoked too much and pull over to sleep it off, also Frank Solich. All the same. DUI....no points given for not driving but sleeping.
According to the story the police were responding to a report of an erratic driver. I'm sure that came with a description of the car if not a plate number. The police found the vehicle with the driver inside, basically unrepsonsive, car in gear, stinking like alcohol. He couldn't do a field sobriety test and refused a breathylizer. This sounds like a slam dunk to me. I would assume he's done for the year. Anything less and Meyer would be eligible for an adjoining cell in my book.
I suspect he will be suspended. The only doubt that I might have is what gipper posted. I can't tell you how unhappy this makes me and I am sure it bothers Meyer a lot. Not just the game coming up, but what he invests in getting these guys to not only perform but do right things. It definitely puts a damper on things. By the way Trattou will very possibly be the starter.
In Texas, being in the driver's seat implies intent and it is the same as actually driving. I don't know if the laws in Florida are that strict or not.
As a college and, in particular, SEC football fan, I sincerely hate to hear this. I especially dread all of the commentary from the media this will bring about, particularly from the SEC's detractors who will see this as another instance of no discipline when it comes to SEC football players instead of a very dumb and dangerous mistake by a young adult who really should have known better. You can't babysit these kids. When you become an adult it is your responsibility to act responsibly not your coach's or even your parents'. Unfortunately, not all see it that way.

I hate to see this happen. This should be a great game and I would have liked for both teams to be at full strength.
