    The restaurant and the driver of the stalled vehicle and the tow truck that he ran into on that fatefull night. I've seen a couple of these suits and while I don't know Missouri Law (or Texas law for that matter), but it does seem clear that the establishment has some legal liability when it comes to them continuing to serve alcohol to a patron who is had too many already.

    I don't know though about the Tow Truck Driver or the stalled car.

    The suit against the Shannon's is brought under what are commonly called "Dram Shop" acts. These make a liquor licensee liable for serving someone illegally. Serving someone who is visibly intoxicated is illegal.
    Years ago, here in Michigan they changed the law so that the family of the drunk could no longer collect. It's one thing if he goes out and hits someone else causing injuries. It's another when the drunk goes out and kills himself.
