Today President Obama declared Executive Privilege to protect Attorney General John Mitchell...wait...I mean Attorney General Eric Holder who has refused to turn over documents to the House committee that is investigating Holder's (and Obama's) role in the Fast and Furious gun-running scandal that killed dozens of Mexicans and a U.S. Border Patrol agent. The scandal has dragged on for more than a year now as Holder has repeatedly promised to provide the documents, then failed to produce them. The lib/Dem hope now is to delay the investigation past the election...just as Nixon did with the Watergate scandal 40 years ago last week during the 1972 election... Via Fox News: President Obama has granted an 11th-hour request by Attorney General Eric Holder to exert executive privilege over Fast and Furious documents, a last-minute maneuver that appears unlikely to head off a contempt vote against Holder by Republicans in the House. Family of Border Patrol Agent Killed With Fast And Furious Weapon Slams Obama For “Compounding Tragedy” With Executive Privilege Assertion… Like Obama gives a rip. Via ABC News: The family of slain U.S. Border Patrol agent Brian Terry, who was killed with guns tied to the Fast and Furious program, issued a statement Wednesday afternoon accusing President Obama of compounding their family tragedy by invoking executive privilege. President Obama invoked executive privilege to shield the Justice Department from having to release documents sought by House Republican investigating the secret law enforcement program, wherein weapons smugglers were permitted to buy guns so law enforcement could trace them to drug cartels. Law enforcement lost track of hundreds of the guns, which began showing up at crime scenes, most tragically in December 2010, where Terry was killed. Terry family attorney Pat McGroder on Wednesday released the following statement from Terry’s parents Josephine Terry and Kent Terry Sr.: “Attorney General Eric Holder’s refusal to fully disclose the documents associated with Operation Fast and Furious and President Obama’s assertion of executive privilege serves to compound this tragedy. It denies the Terry family and the American people the truth.” The Terrys said that their son “was killed by members of a Mexican drug cartel armed with weapons from this failed Justice Department gun trafficking investigation. For more than 18 months we have been asking our federal government for justice and accountability. The documents sought by the House Oversight Committee and associated with Operation Fast and Furious should be produced and turned over to the committee. Our son lost his life protecting this nation, and it is very disappointing that we are now faced with an administration that seems more concerned with protecting themselves rather than revealing the truth behind Operation Fast and Furious.”

The vote to hold Holder in contempt today was no surprise. The actions of some Democrats was predictable. Taking a page out of state lawmakers in Texas, Indiana, and Wisconsin, they just walked out at the time of the vote. As in so many of the things that they do, they make a mockery of our governmental process.

(Roll Call) — In the midst of a fiery floor debate over contempt proceedings for Attorney General Eric Holder, House Oversight and Government Reform Chairman Darrell Issa (R-Calif.) quietly dropped a bombshell letter into the Congressional Record. The May 24 letter to Rep. Elijah Cummings (D-Md.), ranking member on the panel, quotes from and describes in detail a secret wiretap application that has become a point of debate in the GOP’s “Fast and Furious” gun-walking probe. The wiretap applications are under court seal, and releasing such information to the public would ordinarily be illegal. But Issa appears to be protected by the Speech or Debate Clause in the Constitution, which offers immunity for Congressional speech, especially on a chamber’s floor. According to the letter, the wiretap applications contained a startling amount of detail about the operation, which would have tipped off anyone who read them closely about what tactics were being used. Holder and Cummings have both maintained that the wiretap applications did not contain such details and that the applications were reviewed narrowly for probable cause, not for whether any investigatory tactics contained followed Justice Department policy. . . . In Fast and Furious, agents for the Bureau of Alcohol, Tobacco, Firearms and Explosives allowed assault guns bought by “straw purchasers” to “walk,” which meant ending surveillance on weapons suspected to be en route to Mexican drug cartels. The tactic, which was intended to allow agents to track criminal networks by finding the guns at crime scenes, was condemned after two guns that were part of the operation were found at U.S. Border Patrol agent Brian Terry’s murder scene.

Lew claimed Fast and Furious started during the Bush administration. That assertion is false. Operation Fast and Furious started in September 2009, President Obama took office in January 2009. Lew also went on to defend Attorney General Eric Holder by saying this was a “regional program.” If that was the case, then why is executive privilege necessary or valid in this case? Either the documents requested show some kind of White House communication or President Obama improperly asserted the privilege to buy Holder more time. Lew also said “every document related to the decisions up to that point has been shared,” which is also false. There are 240,000 Fast and Furious documents available. The Justice Department has turned over 7,000. Of those 7,000 the majority are sheets of black ink due to extreme redaction. In relation to specific communications, just before the Oversight Committee contempt vote two weeks ago to hold the Attorney General in contempt, Chairman Darrell Issa narrowed his focus from 70,000 documents to 1300, yet Holder still failed to deliver anything substantial. Not to mention, 21 Democrats voted for civil contempt against Holder last week, which destroys Lew’s “political” argument.
